RHOVY, LLC.


Overview

This privacy policy ("Privacy Policy") explains how Rhovy Inc. (or "we", “our”, or “us”) collects, uses, discloses, processes, and protects your personal information when you visit or use our website located at www.rhovy.com and all other Rhovy-branded websites and mobile applications (each, a “Website”), and any content, software applications, online services, and other functionality and services provided by Rhovy through any Website (collectively, the “Service”).


We revise this Privacy Policy from time to time to reflect changes in our business, Service, or applicable law. If we revise this Privacy Policy, we will notify you by revising the date on this Privacy Policy. In the event of a material change, we will provide you with additional notice (e.g., sending you an email notification.)


To the extent that Rhovy has links to other websites (like retailers), please note that we do not own, operate, or control them, and they have their own controlling privacy policies that you should review.


Sources of Personal Information We Collect

We collect information about you in a variety of ways when you sign up for our Service, use our Websites or otherwise interact with our Service. These sources of personal and other information occur during the following:


Registration.

When you register for our Service we collect information about you, including if you choose to sign up through an account on a third party platform (like Google®), Rhovy will store this information for login purposes.


Contacts with Us.

When you communicate with us through email or other means.


Retail Sites.

When you use Rhovy, we collect commercial information about you from third parties: including service providers, retailers, and operating systems.


Using our Service; Internet or Network Activities.

We collect information about you from your engagement with our Service, when you visit a Website and when you are on a website that offers or describes our Service. This may include retail websites, search engines, AI chatbot sites, blogs, our website, or other services.


Categories of Personal Information We Collect

Personal Identifiers.

During the registration process we may collect your name, email address, IP address, your device's unique ID (where available), member password and other registration information.


Information you provide when you contact us .

We may also collect any other information you provide when you communicate with us through email or other means.


Information you provide when you sign up through a third party account.

If you choose to sign up through a third party platform (like Google), Rhovy will store this information for login purposes. Signing up through a third party platform grants Rhovy access to the profile, but only to the extent allowed by your permission settings, that platform's terms of service, and this Privacy Statement.


If you purchase an item on a third-party merchant's website displayed or linked on our Website or browser extensions, that merchant (not Rhovy) will collect, store, and process your payment information in connection with that purchase.


Commercial Information.

We collect information about your purchases on retail sites when using Rhovy as well as shopping activity and goods or services considered on our merchants, partners, sites or businesses that our users transact with for the purpose of obtaining goods or services ("Partners and Merchants"). This may include data such as:


  • Order total amount

  • Order number (if visible)

  • Store/merchant name

  • Product names and descriptions

  • Purchase date

  • Your shipping address only if displayed on purchase confirmation page


We do not collect:

  • Your payment card information

  • Your billing address

  • Login credentials on any third-party merchant retail sites


Internet or Network Activity.

We collect this information to develop, improve, market and provide our Services. This may include data such as:

  • The type of device you're using

  • Operating system

  • Browser type

  • Event stamp

  • Error logs

  • Information about the site, products searched for and products shown

  • Information about pricing and availability of items

  • Name of the retailer

  • Page views

  • Your search queries and results

To understand how you engage with our Services, we use common digital tools that allow us to see if you opened an email we sent, visited a link in those emails, or generally interacted with Rhovy as a result of our marketing efforts.


Shopping and Usage Data.

Rhovy collects the name of the retailer, website domain, page views, and in some cases, product information that allows us to track price changes.


We may also collect information regarding your purchases on a merchant’s retail site while using  Rhovy (for example, the transaction value, and the fact that an order was completed or returned) for purposes including internal analytics, commission collection, and managing our “Rho”. The information enables us to improve our products and gives us insights about coupons, deals, pricing, and availability of retail items, which we can offer to the rest of the Rhovy community. 


We may also use this information to understand your shopping history, merchant and shopping preferences to provide you with a more tailored, relevant experience or show sponsored product offers that may interest you when you use the Services.

As you use our Services, we might also collect data, such as:

  • Friend referrals from your contacts to Rhovy

  • Merchants you "follow" on Rhovy

  • Items you have saved to cart on a merchant’s website


Inference Data.

We may infer information about you such as your preferences and shopping behavior, based on your interactions with our Services or with our Partners and Merchants.


Sensitive Personal Information.

We may disclose your sensitive personal information as appropriate to carry out legitimate business activities allowed by law, but we do not sell or share your sensitive personal information.


Aggregate and Anonymized Data.

We may also use the information we collect in aggregate or otherwise anonymized form. This lets us look at interactions with our site and products generally and does not identify you or any specific person. We use this general data for research, development, marketing, analytics, and to enhance the shopping experience for the Rhovy community. We will not attempt to reidentify aggregated and anonymized information, except in instances where necessary for determining whether the deidentification process used by Rhovy satisfies the requirements under applicable law.


Where we obtain your data

We may obtain the above categories of personal information from the following different sources:

  • From you: including from your engagement in our Services and when you are on a website that offers or describes our Services. This may include retail websites, search engines, AI chatbot sites, blogs, our website, or other Services.

  • Third parties: including service providers, retailers, and operating systems.

  • Connected Accounts: accounts on third-party platforms you agree to link to Rhovy.


Why we collect your data

In addition to the uses described above, we also collect your information for a variety of reasons, including to provide our Services as well as for the following reasons:

  • To provide our Services: such as to set up your account, award you Rho, create an inventory of functioning rewards, award you, manage Rho and your rewards.

  • To manage and improve our Services: to make sure our Services and products are working correctly and conduct internal analytics.

  • To communicate with you.

  • To manage fraud and risk.

  • To personalize your shopping experiences, including when you use the Service to provide you with a more tailored, relevant experience or show sponsored product offers that may interest you, see a personalized recommendation feed.

  • To market our Services, including when we associate information about you.

  • To process information about your contacts: with your consent, we may collect your friends’ contact information for referrals.

  • To comply with laws: to comply with applicable laws and rules and enforce our agreements with you and other people who use our Services.


How we disclose your data

We do not sell personal information to third parties for money or share your personal information for cross context behavioral advertising, including sensitive personal information, for cross context behavioral advertising. We may disclose your sensitive personal information as appropriate to carry out legitimate business activities allowed by law.

We may disclose your personal information with your consent or in ways you'd expect. We may disclose information with the following categories of third parties:

  • With our service providers (businesses that work for and with us) for the purpose of running Rhovy and fulfilling our commitments to you. These include businesses that perform services on our behalf, including to help us maintain our applications (including Website and our extension), manage rewards, to provide support for legal, banking, security protection, payment processing, our own marketing, and customer service. Please know that when we disclose information with our service providers, it's for the purposes outlined in this Privacy Statement and not for their independent use. The personal information we disclose may include your identification information, your shopping and usage data, internet or network activity, commercial information, inferences, and sensitive personal information.

  • With your consent, to Partners and Merchants that you and we interact with, to help ourselves and our Partners and Merchants personalize services when you shop with Rhovy so you can have a better and more relevant experience. Personal Information we disclose includes, for example, products, brands, sizes, preferences and styles we think you’ll like.

  • If you decide that you prefer to no longer participate in sharing for the personalized Rhovy offers, you may change your preferences in your account settings. If you opt-out, we will continue to disclose your personal information necessary to complete transactions you initiate, but will not disclose personal information to Partners and Merchant for personalized experiences.

  • With authorities, as required by law, or to comply with or respond to a valid government request; or when we believe in good faith that it's necessary to protect our rights, protect your safety or the safety of others, or investigate fraud. The personal information we disclose may include your identification information, your shopping and usage data, internet or network activity, commercial information and sensitive personal information.

  • With a buyer or successor if Rhovy is involved in a merger, acquisition, or similar corporate transaction. If that happens, you will be provided with reasonable notice of any change in ownership, as well as any choices you will have as a result. The personal information we disclose may include your identification information, your shopping and usage data.


How we secure your data

The security of your information is important to us. Rhovy has implemented an information security program that contains administrative, technical, and physical controls that are designed to reasonably safeguard personal information. These measures include limiting access, encryption using TLS 1.3 (HTTPS), hashed user passwords using industry-standard algorithms, API authentication using JSON Web Tokens (JWT) with secure secrets, testing for vulnerabilities, advanced malware detection, employing pseudonymization and anonymization techniques, and more.


Despite our efforts, we can't guarantee that user information will not be accessed, viewed, disclosed, altered, or destroyed as a result of a breach of any of our safeguards. You provide us with information at your own risk.


How long we store your personal information

We retain personal information for as long as needed or permitted in context of the purpose for which it was collected and consistent with applicable law.

The criteria used to determine our retention period is as follows: personal information used for the ongoing relationship between you and Rhovy is stored for the duration of the relationship plus a period of 10 years, unless we need to keep it longer, such as:

  • a legal obligation to which we are subject.

  • consistent with the applicable law.

  • litigation, investigations, audit and compliance practices, or to protect against legal claims.

The reason we may retain your personal data after you close your account is for necessary reasons to continue operating our business effectively, to maintain a record of your transactions for financial reporting purposes or fraud prevention purposes until these purposes no longer exist, and to retain as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Data disclosed to Rhovy is subject to data retention periods as set out in the Privacy Statement.


How we use cookies and similar technologies

Rhovy only uses cookies, pixel tags, web beacons, and other online tracking technologies (we'll just call them "cookies") on the Website (not our browser extension) to collect some of the data discussed in this Privacy Statement. These help us operate our Services, analyze engagement and usage, and provide a relevant and personalized shopping experience. See below to learn how you can manage your cookie preferences.


Some cookies can be temporary (“session cookies” like those used for navigating your browser) and disappear once you close it. Others last longer (“persistent cookies,” like when you ask a site to remember your login) and are saved to your computer until you delete them.

Our uses of cookies and similar technologies fall into this category:

  • Analytics: We may use cookies, web beacons, or other similar technologies to assess the performance of our websites, applications, services, and tools, including as part of our analytic practices to help us understand how our visitors use our Services, determine if you have interacted with our messaging, determine whether you have viewed an item or link, or to improve our website content, browser extensions, applications, services, or tools.

Browser Extension Data Storage

Our browser extension stores the following data locally on your device using browser’s local storage API (not cookies):

  • Authentication tokens (to keep you logged in)

  • Records of processed purchases (to prevent duplicate processing

  •  Transaction history cache

  • User preferences

This data remains on your device and is only transmitted to our servers when you actively use the extension's features. You can clear this data by removing the extension or clearing browser data.


Your choices for managing your data

You have certain rights with regard to your personal information:

  • You have the right to know and request information about the categories and specific pieces of personal information we have collected about you within the last 12 months, as well as the categories of sources from which such information is collected, the purpose for collecting such information, and the categories of third parties with whom we share such information. You also have the right to know if we have sold or disclosed your personal information for business purposes.

  • You have the right to update your personal information

  • You have the right to request a portable copy of your personal information

  • You have the right to request that Rhovy delete your personal information, subject to certain exceptions allowed under applicable law.

  • You have the right to opt-out of certain disclosures of your personal information for valuable consideration. You can exercise this right by emailing us at hello@rhovy.com.

  • You have the right to not be discriminated against for exercising any of the above-listed rights. We may, however, provide a different level of service or charge a different rate reasonably relating to the value of your personal information.


Upon your request, we will delete any personal information we have, although the following exceptions apply: (1) we may still store your personal information if we need it to meet our legal or compliance obligations and/or to defend against legal claims; and (2) we may also continue to store your personal data in an aggregated and anonymized format that doesn't identify you and can't be attributed to you, even after you've deleted your profile.


Notice to California residents

If you are a California resident or another State that has comparable consumer rights by law, the laws of your State may provide you with additional rights regarding our use of your personal information.

California's "Shine the Light" law (Civil Code Section § 1798.83) permits users that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Minors

We created Rhovy for the exclusive use of adults (18 and older). We don't knowingly collect or solicit personal information from children. If you are a child under 18, please do not attempt to use or register for our Services or send any personal information to us.


If we learn we have collected personal information from someone under 18, we will delete that information as quickly as possible. If you are a parent or guardian of a child who you think may have given us some personal information or posted information on any public portion of  our Services, please let us know at hello@rhovy.com. We'll help you remove it.
